USER AGREEMENT
1. OBJECT OF AGREEMENT
1.1 This Agreement is
concluded between the www.sportpicks.biz sports analytical service
(hereinafter Service) through and by its proprietor, A.N. Bushuyev, and
a subscriber of this service (hereinafter Subscriber) that Service
shall provide Subscriber with a paid service – sports forecasts
for tennis events with tips for placing bets at bookmaker offices.
1.2 By making a payment to the
Service, Subscriber automatically agrees with the terms and conditions
of this Agreement.
2.
SUBSCRIBER’S RIGHTS AND OBLIGATIONS
2.1 Subscriber shall not
deliberately spread explicitly libellous and defamatory information
about Service’s operation.
2.2 Subscriber shall not
resort to fraud, cracking the Service’s site database or any
other actions in relation to Service which are illegal according to the
Russian and international law.
2.3 Subscriber shall make
payments for the services as 100 per cent advance payment of the price
which is valid at the moment of making such a payment.
2.4 Subscriber shall not by
any means make public, spread or sell the Service-provided forecasts
contained in the paid mail.
2.5 Subscriber must realize
that in the sphere of gambling, and also in the sphere of investments,
there is an ever-present risk, and this risk shall be assumed only by
the person taking final decision as to whether to place a bet of any
kind or not.
2.6 Subscriber has the right
to interrupt his/her usage of the services for a desired number of
calendar weeks, upon prior notice to Service.
2.7 Subscriber has the right
to rescind this Agreement and to refuse to make use of the services in
case of changes of its terms and conditions within 7 days, in which
case all monies unused by Subscriber shall be returned to him/her.
2.8 Subscriber has the right
to unilaterally rescind this Agreement and to refuse to make use of the
services in case of Service’s non-fulfilment of any condition of
this Agreement, in which case all Subscriber’s monies shall be
returned to him/her in full amount.
3.
SERVICE’S RIGHTS AND OBLIGATIONS
3.1 Service reserves the right
to change the terms and conditions of this Agreement upon prior notice
to Subscriber.
3.2 Service shall provide
Subscriber with forecasts for tennis events (recommendations) to place
bets at bookmaker offices, and by using such forecasts Subscriber shall
be able to receive financial profit in case of long-term gambling.
3.3 Service shall provide
Subscriber with forecasts from Monday to Saturday, at least two times a
week, between 10:00 and 10:15 GMT and between 16:00 and 16:30 GMT, and
at least half-hour before the beginning of the matches
for which forecasts are provided.
3.4 Service shall deal only
with those bookmaker offices with which Subscriber’s gambling
payroll has been placed upon Service’s recommendation,
namely: Fon, BetCity, Pinnacle.
3.5 Service shall not advise
Subscriber to place stakes exceeding a maximum allowable amount, i.e.
3% of the gambling bankroll per a stake.
3.6 Service shall assess the
outcome of every match in strict compliance with the rules of that
bookmaker office where Service advised to place a stake.
3.7 Only those odds shall be
deemed valid and taken into account to estimate the balance and the
rendered services which were documented by the www.betonsuccess.ru
tracking service for posting by SportPicks.T.L.
3.8 Service shall not be
responsible for the operability of the e-mail service specified by
Subscriber; it shall not be liable for untimely receipt of e-mails, for
any changes in bookmakers’ lines after the mailing list has been
posted and for any other circumstances which may prevent Subscriber
from making use of the received forecasts.
3.9 Service has the right to
interrupt rendering its services, upon prior notice to Subscriber,
during a tennis season once a year for a vacation period not exceeding
four calendar weeks.
3.10 Service has the right to
interrupt rendering services for excusable reasons which are beyond
Service’s control: a glitch in the system or network, the
handicapper’s (the service proprietor’s) illness, an
accident, etc.; in such cases Service shall inform Subscriber about the
reason for interruption as soon as possible.
3.11 Service has the right to
terminate rendering services to Subscriber for his/her violation of any
of the terms and conditions of this Agreement. In such a case all
monies, pre-paid and not used by Subscriber, shall not be returned.
